JAMMU: Police remand of GMC HoD framed in sexual harassment incident after complained by a female patient has further been extended.
Chief Juridical Magistrate Jammu Ashwani Sharma on Tuesday rejected the bail application of leading Neurologist, Head of Neurology Department of Government Medical College (GMC) Jammu for allegedly molesting a patient.
Meanwhile, City Judge Jammu this afternoon extended the police remand of Dr. Bodh Raj Kundal till September 9, 2017.
The doctor was arrested on August 31 but so far Health and Medical Education Department has not placed him under suspension.
According to rules, a government servant who is detained in custody, whether on a criminal charge or otherwise, for a period longer than 48 hours, has to be placed under suspension by the appointing authority.
Health Minister Bali Bhagat while talking to Media Sources on Sunday had said that Dr Kundal will be suspended on Monday. However, till the filing of this report no such order was issued.
The CJM Jammu after hearing CPO Ashish Rathore with Senior Prosecuting Officer M.A Almansoor and Prosecuting Officer Arvind Manhas for the police and Advocate Rajesh Gupta for the doctor, observed that it is true that bail is rule but jail is exception. “However present case falls within the exception, because the profession of doctors being a very sacred profession and if the doctors themselves indulge in such type of crimes, the faith of the general public particularly the women folk shall be shaken. There is no reason to implicate the accused by the prosecutrix in false case”, With these observations the Court rejected the bail application.
On August 31, Police had arrested the framed doctor when a Reasi based girl lodged a complaint with Bakshi Nagar Police Station, alleging sexual harassment.
