Bhim Singh Challenges Domicile Law For Inducting Non-residents In Jobs


Jammu: Prof Bhim Singh has challenged latest law inducted in J&K by the Government to bypass Permanent Residents Rules in J&K by inducting non-residents in jobs and depriving permanent residents of Jammu & Kashmir of their jobs and work in Government offices, even for class-IV, class-III and class-II jobs.

Prof Bhim Singh regretted that BJP government in the Centre has been acting in violation by infringing the spirit and command of Constitution of India.

Prof Singh said that Article 370 (1), which has been retained by the present rulers, is very clear that the Parliament of India has not implemented the Accession of the State of Jammu & Kashmir. Parliament has also not amended the Constitution to accept the Instrument of Accession signed by Maharaja Hari Singh on 26th October, 1947.

Moreover, the Parliament has not taken over Defence, Foreign Affairs and Communications with allied matters, which were retained with the Executive power of J&K by the Maharaja. Unless Parliament of India acquires entire State of Jammu & Kashmir by its Parliamentary decision, that three subjects retained by the Maharaja with him, shall also be given to the authority of Parliament, the Instrument of Accession remains intact.

Present BJP government has neither acted in accordance to International Law nor in accordance with the Constitution of India while declaring Jammu & Kashmir as two Union Territories. This matter should be understood by the rulers of India, who are dictating pro-BJP laws in J&K in violation of Constitution of India as well as International Law.

Prof Bhim Singh urged the President of India to convene an urgent meeting of representatives of all recognised political parties of J&K and those which are functioning in Jammu & Kashmir. The matter deserves earliest attention of the President lest Intentional Court of Justice intervention comes into play, he maintained.
