Jammu, June 13: A minor girl has recorded her statement before a CJM about alleged sexual abuse in police custody by a SHO. The CJM would now produce it before the high court in a sealed cover on or before July 11 next.
A criminal Miscellaneous Petition for recording the statement of prosecutrix’ mother before a competent judicial magistrate/the same magistrate who had recorded victim’s statement or recording of mother’s statement has also been filed.
The petition filed by the victim thorough her counsels includes recording of the statement by any other competent court which the high court may deem fit and proper in the facts and circumstances of the case.
“The prosecutrix was a student of 9th class when on May 1, 2016, the accused committed rape on her,” alleges the petition.
The petition further adds that when the victim approached the higher police officers for action against the accused SHO, they just ignored her pleas. Instead of taking action against the accused, the officers started oppressing her, alleges the petition.
“The irony is that the person, who is the accused, was directed by a senior officer to arrange her presence in his office, which the accused has himself placed on record in the main petition,” the petition says.
A petition under section 561A of CrPC has also been filed by the SHO of police station, Bagh-e-Bahu, against the process initiated by the municipal magistrate, Jammu, for commission of offence under section 354-A of RPC.
