Jammu, Aug 12: A sessions court in the city has sent summons to a girl on the basis of a complaint filed by a youth who alleged that he was falsely implicated for rape by the girl. A copy of the complaint was also sent to the girl alongwith the summons.
In his complaint, the youth has mentioned that he held friendly relations with the girl and that he used to visit the female’s residence regularly. The youth further says in the complaint that he had financially supported the girl on a few occasions as well.
It was when the youth asked for his money that the girl lodged an FIR against him which was registered under sections 376 and 452 of RPC on August 28, 2015 at the Bakshi Nagar Police station.
The challan of the case was presented in the court of 3rd additional sessions judge, Jammu. During trial, the girl turned from her statement recorded under section 164 A of CrPC and admitted that no rape was committed on her.
On the basis of her admission of the changed facts, the court acquitted the youth of the charges leveled against him under sections 376 and 452 of RPC.
The youth in his complaint has pleaded that due to false allegations leveled against him he had lost his reputation in public.
He further state in the complaint that even his mother has had to face humiliation publicly further saying that he had also suffered a huge loss of money and career.
The court stated that keeping in view the overall aspect of the matter, the record available on the file prima-facie discloses commission of offence under section 500 (b) of RPC against the accused while there was no specific allegation against the mother and the brother of the girl, so there was no sufficient ground for proceeding against them for commission of offence under section 500 (b) of RPC. As such, the complaint to that extent was dismissed at this stage.
The court also directed to issue summons to the accused girl for her appearance along with a copy of the complaint on August 12, 2016 for further proceedings.
