J&K cadre senior officer summoned by court in Sexual harassment case

SRINAGAR: Delhi chief Metropolitan Magistrate Sumit Dass on Wednesday summoned a senior KAS officer posted as special secretary in Roads and buildings department, Asif Hameed Kahn in the case of allegedly sexually harassing a junior woman KAS officer.

According to lawyer Suhail Malik, the Police have registered an FIR against Asif Khan under Sections 354-A and 509 of the Indian Penal Code on directions of the Delhi high court.
 “The case was registered against Khan on the basis of complaint filed by a junior lady KAS officer for forcing her to develop physical relations with him . The Court order comes after the Delhi Police had sought closure of the case citing lack of evidence for prosecuting Khan,” lawyer of the complainant Suhail Malik said.

The female officer had filed a protest petition through her Lawyer Suhail Malik seeking dismissal of the closure report.  The former Dy. Advocate General appearing as the Complainant’s lawyer pointed out that the Investigation officer of the case had deliberately tried to eclipse statements of various important witnesses who had testified against Khan, the court order said.
Pertinently, these witnesses include two female KAS officers and MLA (Banihal) Vikar Rasool who was then MOS (Hospitality & Protocol).
The Chief Metropolitan Magistrate Sumit Dass while holding that the IO of the case is wrong in his opinion and that there is ample material on record, has summoned Khan through the Resident Commissioner of J&K at Delhi and has asked him to appear on 16th November to face trial.
