The deadline to link PAN (permanent account number) with Aadhaar is December 31, 2019, earlier the last date to link was September 30, 2019, as per the notification of the Ministry of Finance dated September 28, 2019.
As per the notification by the finance ministry, all the individuals who have been allotted a PAN and is eligible to get an Aadhaar number have to link the two together. Earlier this year, the Supreme Court also upheld the section 139AA of the Income Tax Act, 1961 which makes PAN-Aadhaar linking mandatory. Also, it is already mandatory to quote the Aadhaar number while filing income tax returns (ITR).
In July, the Budget changed the PAN-Aadhaar linking rules. Initially, the law was if PAN was not linked with Aadhaar by a notified date, then PAN would have become invalid. However, these rules were amended in July 2019 Budget where the document said, “Presently, the Act provides for making PAN invalid if it is not linked with Aadhaar within a notified date. In order to protect past transactions carried out through such PAN, it is proposed to provide that if a person fails to intimate the Aadhaar number, the PAN allotted to such person shall be made inoperative in the prescribed manner after the date notified for the said linking.”
Worth mentioning here is that in Budget 2019, the government had revised the consequences of not linking PAN with Aadhaar. According to the revised rule, the word ‘invalid’ was substituted with the word ‘inoperative’ so as to protect the past transactions using PAN.
How to link Aadhaar number with PAN-
(a) SMS: Send an SMS to 567678 or 56161 from your registered mobile number in the format- UIDPAN
For instance, UIDPAN 123456789000 EPOPE1234E
(b) Online: By visiting the website of the PAN service providers (i.e., www.tin-nsdl.com or www.utiitsl.com). Click on the ‘Link Aadhaar to PAN’ tab which will direct you to the income-tax website. You can also link by visiting directly the e-filing website (www.incometaxindiaefiling.gov.in).
(c) Paper mode: File one-page form along with minimal fee with the designated PAN centre. Copies of PAN card, Aadhaar card are to be furnished.
While linking, it is important to make sure that there is no mismatch of name, date of birth (DOB) and gender. In case of any mismatch, one can rectify it either from UIDAI for Aadhaar or UTIITSL for PAN related problems.
