Srinagar, January 21: The candidates with Ph.D degrees with university grants commission (minimum standards and procedure for award of Ph.D degrees regulations) 2009 can appear in the interview for the posts of Assistant Professors in several colleges in the state to be conducted by Public Service Commission, directs The State High Court on Wednesday.
The observation has been made by a single bench of the court comprising Justice Ali Mohammad Magrey in a petition filed by the number of candidates who had cleared the written exam but were disallowed to appear in the interview. The bench has also directed the respective universities to issue certificates in favour of eligible candidates within a week.
Advocate M Y Bhat, the counsel for petitioners argued that the they are entitled to the benefit of exemption from written test as they have been awarded with Ph.D Degrees in accordance with university grants commission (minimum standards and procedure for award of Ph.D degrees regulations), 2009. They should be allowed to participate in the interview.
He further said that there is no mechanism provided in SRO 124 of 2014 (amending J&K Education Gazetted College Service Recruitment rules 2008) and as such commission cannot determine the eligibility with regard to grant of benefit of exemption as such authority is only vested with the university concerned. Also, it is not difficult for them to get the certificates produced with reference to having completed the courses in accordance with the regulations of 2009, from the concerned universities but it will take time and by the time they will approach respondent universities and obtain certificates, the process of interview will be complete.
