Srinagar, September 09: Penalty slapped on Senior Law Officer of State Services Recruitment Board by State Information Commission for denying information under the JK RTI Act.
As per details provided in a news daily, an RTI applicant from Uri in Baramula in May this year filed an RTI application before PIO Javid Ahmad, JKSSB in which he sought information related to some appointments made by SSRB. He wanted to know about the selection of teachers in Baramula by SSRB and the information regarding the points scored by some candidates in written test and viva.
As prescribed under the RTI Act, he was to be provided with the reply before 1st of June but the applicant did not get any kind of response.
Having not received any response from FAA, appellant approached State Information Commission (SIC) with his 2nd appeal under Section 16 of the J&K, RTI, Act, 2009 and the information was denied to the information seeker until the SIC issued notices against SSRB.
Taking all these facts on record, the Commission holds that there was no reasonable cause which could have justified the cause of delay in providing response to RTI applicant and State Information Commission has now issued a notice to Javid Ahmad with a notice period of 30 days.
SIC in its notices asked the Senior Law Officer-cum-PIO, JKSSB to give a valid reason that why the response was not provided to the applicant in his first attempt. Also since the information has been sent far beyond the statutory period of time, as prescribed under the Act, Ahmad needs to explain why penalty under Section 17 of the J&K, RTI Act, 2009 may not be imposed on him.
